An SR-22 is a form that is filed with your state to show that you are meeting your state’s minimum auto liability insurance requirements. An SR-22 may also be referred to as a certificate of financial responsibility.

WHO NEEDS AN SR-22?

Not every motorist needs an SR-22. Laws vary by state, but in general, drivers may need to have their insurance company file an SR-22 form with the state department under the following circumstances:

  • Conviction for driving under the influence or driving while intoxicated
  • Serious and/or repeat traffic offenses
  • An at-fault accident with no insurance
  • License suspension or revocation

Since an SR-22 is required for these types of offenses, it usually results in a surcharge on your auto insurance.

HOW LONG DO YOU NEED TO HAVE AN SR-22?

SR-22 terms and requirements vary by state, but here are some guidelines to keep in mind:

  • You’ll likely need to have an SR-22 showing continuous insurance coverage for about three years (longer in some states).
  • If your policy lapses or expires during this period, your insurance company is required to notify the state.
  • Failure to comply with the terms of your SR-22 may result in suspension of your license.
  • Once you properly fulfill your state’s time requirements, your SR-22 status is typically lifted.

SR22, SR-22, SR 22, SR22 form: Is it all the same?

Yes, no matter how you reference SR22, all the above examples refer to SR-22 car insurance for drivers. Insurance companies may have a preference in how they use the term SR22 in print and online, but it’s all referring to the CFR filing you need to do to meet your state’s insurance requirements.

IF I DON'T OWN A CAR, DO I STILL NEED TO FILE AN SR-22?

If you don’t own a car, you may still be required to have an SR-22 certificate and an SR-22 auto insurance policy. If you drive a borrowed car or rent a car and get into an accident, you could still be held liable for personal injury or property damage claims. You may be able to buy a non-owner SR-22 policy. If your license was suspended, in some cases you may even be required to get a non-owner SR-22 in order to reinstate your driving privileges.

If you are required to file an SR-22, contact your insurer to obtain the documents for submission to your state’s appropriate department.

Is there a fee associated with an SR-22/FR-44?

  • Most states charge a flat fee, but others require a surcharge.
  • This is a one-time fee you must pay when we file the SR-22/FR-44. The only time you will have to pay more is if your policy lapses.
  • A filing fee is charged for each individual SR-22/FR-44 we file. For example, if your spouse is on your policy and both of you need an SR-22/FR-44, then the filing fee will be charged twice.

Can I get an SR22 today?

  • Most states require drivers to have SR22 coverage along with an insurance policy for about three years. This may vary by state or by circumstances, so be sure to check your state’s requirements and ask your insurance carrier for specifics.

What if my policy cancels?

  • If your SR-22 lapses, your insurance company is required to contact the Department of Motor Vehicles (DMV). This could result in loss of your driver’s license or, depending on your state of residence, other consequences. Making payments on time will help keep a policy from canceling and prevent an SR26 from being sent to the state. An SR26 cancels the SR22 with the state.

    In turn, if an SR22 is no longer needed, an SR-26 form is also filed to remove the SR22 requirement.

Will an SR22 raise my insurance?

  • With many companies, yes—but not Texas Shield. Generally, just having an SR-22 filing on your policy will not impact your car insurance premium at Texas Shield.

What types of SR 22 certificates are there?

  • There are three types of SR22 insurance:

    • Operator: An Operator’s Certificate is designed for drivers who borrow or rent a car, but don’t own a car. This is sometimes used with a non-owner car insurance policy
    • Owner: An Owner’s Form is for those who own and drive their own car.
    • Operator/Owner: An Operator/Owner Form is a combination form that applies to those who own their own car, but also borrow or rent one to drive occasionally.

Can I get an SR-22 if I don’t own a car?

  • Yes. You can get SR22 insurance if you don’t own a vehicle with our non-owner car insurance policy. Non-owner car insurance protects you in the event you’re found to be at fault in an accident while driving a vehicle not owned by you. It’s a secondary coverage that pays for damages above and beyond what might be covered through the car’s primary insurance.

Does my state require an SR 22?

  • Each state has its own SR-22 coverage requirements for drivers, which are subject to change. If you’re not sure of these requirements, we recommend contacting your state’s Department of Insurance.

SR22 vs. FR44: What’s the difference?

  • In Florida and Virginia, in some cases an FR 44 may be required instead of an SR-22, based on your driving record. Here are Florida’s car insurance requirements. And here are Virginia’s car insurance requirements.

    Similar to an SR 22, the FR-44 is a document of financial responsibility proving that you carry car insurance. However, an FR 44 may require your liability coverage limits to be significantly higher than the state minimum.

    While the duration might vary, an FR44 is also usually required for three years. By law, an FR 44 policy can’t be canceled.

What’s a certificate of financial responsibility (CFR)?

  • A certificate of financial responsibility is another term for SR22 insurance, showing that you’re meeting your state’s minimum car insurance requirements for a specified amount of time.
